Welcome to the website of Messy Middle Studio (“Messy Middle,” “we,” “us,” or “our”). These Terms and Conditions govern your use of our website and your requests, registrations, purchases, and bookings for birthday parties, classes, workshops, events, products, and other services.
By using this website, submitting a form, requesting a booking, registering for a program, or purchasing a product or service, you agree to these Terms and Conditions and our Privacy Policy.
ADULT USE OF THIS WEBSITE
Our booking, registration, contact, and payment forms are intended to be completed by adults who are at least 18 years old.
Messy Middle Studio provides creative experiences for children, but children should not submit personal information through our website. A parent, legal guardian, or other responsible grown-up must complete forms and provide any information needed for a child’s participation.
By submitting information concerning a child, you confirm that you are authorized to provide that information.
BOOKING REQUESTS AND CONFIRMATION
Submitting a birthday-party or event request does not guarantee or confirm the requested date, time, location, package, project, or service.
Messy Middle Studio will review the request, including availability, location, group size, staffing needs, and other party information. A booking is confirmed only after you receive written confirmation from Messy Middle Studio and complete any required payment or deposit.
Please do not make nonrefundable plans based solely on submitting a request form.
MOBILE PARTY LOCATIONS
Messy Middle Studio birthday parties are mobile experiences held at the customer’s home or another approved event space. Our standard service area is generally within 10 miles of ZIP code 63123 unless we agree otherwise in writing.
The grown-up making the booking must provide a complete and accurate party address. We may decline a location or request additional information if the address, travel distance, parking, accessibility, setup conditions, or available space is not appropriate for the requested service.
The customer is responsible for:
• Obtaining permission to use the selected location
• Providing safe and reasonable access to the party area
• Providing adequate tables, chairs, and water
• Providing nearby parking or loading access when reasonably possible
• Ensuring that the space is clean, safe, weather-appropriate, and ready for setup
• Protecting floors, furniture, clothing, and personal belongings that may be affected by art materials
Messy Middle Studio provides reasonable table coverings and cleanup of our art activity. We are not responsible for preexisting conditions, damage caused by participants, or ordinary mess associated with an art experience.
PARTY AGES, PARTICIPATION, AND SUPERVISION
Our standard birthday-party projects are designed for children ages 4–12 unless otherwise stated or agreed upon.
A responsible grown-up must remain at the party location and be available throughout setup, the activity, and cleanup. The customer and attending grown-ups remain responsible for general supervision, behavior, restroom assistance, food service, and the safety of children outside the art activity.
Messy Middle Studio may pause, modify, or stop an activity if participant behavior, the location, weather, materials, or another condition creates a safety concern.
Some projects may contain small parts or materials that are not suitable for children under age three. Younger siblings and guests should be closely supervised and kept away from materials that may present a choking or safety hazard.
GROUP SIZE AND STAFFING
Party prices and packages include the number of participating children stated in the applicable service description.
Additional participating children may require an additional fee. Parties with 13 or more participating children may require a second instructor and an additional staffing fee.
The estimated number of participating children should be provided accurately when requesting the party. Final attendance must be communicated by the deadline provided in your confirmation materials. We may modify the project, staffing, price, or setup requirements when attendance changes.
Only children included in the final participant count may receive project materials or participate in the guided activity unless Messy Middle Studio approves an addition.
PROJECT AND PACKAGE SELECTION
Available projects depend on the selected package, participant ages, group size, length of the party, material availability, location, and safety considerations.
Project choices may be provided after the booking request has been reviewed. A project is not final until confirmed by Messy Middle Studio.
We may make reasonable material, color, tool, or project substitutions when necessary because of availability, age appropriateness, safety, timing, or circumstances beyond our control. These substitutions will preserve the general nature and value of the experience whenever reasonably possible.
Because creative work is individual, participant results will vary. Images and samples shown on our website or promotional materials are examples and do not guarantee an identical finished product.
ACCESSIBILITY, ALLERGIES, AND ACCOMMODATIONS
We want participants to feel supported and included. Please tell us about relevant accessibility, sensory, mobility, developmental, allergy, or accommodation needs when submitting your request or as soon as possible afterward.
Please provide only the information reasonably necessary for us to plan the activity. We will make reasonable efforts to accommodate disclosed needs, but we cannot guarantee every requested accommodation or an allergen-free environment.
Customers are responsible for managing food allergies and medical needs. Unless explicitly agreed otherwise, Messy Middle Studio does not provide food or medical care.
PRICES AND PAYMENT
Current prices, included services, additional-child fees, staffing fees, deposits, taxes, and other applicable charges will be shown on our website, invoice, booking page, or written confirmation.
Prices and service offerings may change. Changes will not affect a confirmed booking unless the customer later requests a change to the package, attendance, location, duration, or other service details.
Payment instructions and due dates will be provided before payment is collected. A booking is not secured until all confirmation requirements and required payments have been completed.
For registrations managed by a school, community-education program, venue, or other third party, that organization’s payment and registration procedures may also apply.
CANCELLATIONS AND RESCHEDULING
Cancellation, rescheduling, deposit, credit, and refund terms will be disclosed before payment or included with your written booking confirmation. Those specific terms become part of the agreement for that service.
Cancellation or rescheduling requests must be made in writing. A request is not effective until received and acknowledged by Messy Middle Studio.
If Messy Middle Studio must cancel a confirmed service and cannot provide a reasonable rescheduled date, amounts paid directly to Messy Middle Studio for the canceled service will be refunded or credited, as appropriate.
We are not responsible for travel, venue, food, entertainment, decoration, or other expenses paid to third parties.
Programs registered through a school, community-education provider, venue, or partner organization are subject to that organization’s cancellation and refund policies.
WEATHER, ILLNESS, AND EVENTS BEYOND OUR CONTROL
Messy Middle Studio may postpone, relocate, modify, or cancel a service because of illness, unsafe weather, emergencies, hazardous travel, venue problems, government restrictions, supply interruptions, or other circumstances beyond our reasonable control.
When possible, we will work with the customer to find a reasonable solution, such as rescheduling, changing the project, or issuing an applicable credit or refund.
ARRIVAL, SETUP, AND DELAYS
The customer must ensure that Messy Middle Studio can access the party area at the agreed setup time.
If the party begins late because the location is unavailable, guests are not ready, required furniture is missing, or another condition is outside our control, we may need to shorten the activity to honor later commitments. A delayed start does not automatically extend the party or qualify for a refund.
PHOTOGRAPHY
Messy Middle Studio will not use identifiable photographs of a child for advertising or public promotional purposes without separate permission from an authorized grown-up.
Guests should obtain permission before photographing or sharing images of children other than their own.
COMMUNICATIONS
We may use the email address you provide to respond to your inquiry, review a booking request, send confirmation materials, provide service information, issue invoices, and communicate about a requested or purchased service.
Emailing us or submitting a form does not by itself create a confirmed booking or contractual obligation to provide a service.
SMS TERMS
If you voluntarily provide consent to receive text messages, Messy Middle Studio may send non-marketing messages concerning your inquiry or booking, including questions, confirmations, reminders, and booking updates.
Message frequency varies. Message and data rates may apply. Reply HELP for assistance or STOP to opt out. Wireless carriers are not responsible for delayed or undelivered messages.
Consent to receive text messages is optional and is not a condition of purchasing or receiving services. Opting out of text messages does not prevent us from contacting you by email when reasonably necessary to respond to a request or provide a purchased service.
Mobile information and text-message consent will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.
PRODUCT ORDERS
If physical or digital products are offered for sale, placing an order is an offer to purchase. We may accept, decline, or cancel an order because of availability, pricing errors, suspected fraud, shipping limitations, or other reasonable business considerations.
Applicable prices, taxes, shipping charges, estimated delivery information, and return or refund terms will be shown during checkout or in the product description.
Delivery dates are estimates unless expressly guaranteed in writing. We are not responsible for carrier delays or incorrect delivery information supplied by the customer.
WEBSITE CONTENT AND INTELLECTUAL PROPERTY
The Messy Middle Studio name, logo, website design, text, photographs, graphics, project samples, lesson materials, downloads, videos, and other original content are owned by or licensed to Messy Middle Studio and are protected by applicable intellectual-property laws.
You may view and use our website for personal, noncommercial purposes. You may not reproduce, sell, distribute, publish, copy, modify, or commercially use our content, lesson materials, downloads, project instructions, photographs, or branding without written permission.
Artwork created by an individual participant belongs to that participant. Messy Middle Studio retains ownership of its underlying lesson plans, instructions, teaching methods, templates, samples, and original project materials.
ACCEPTABLE WEBSITE USE
You agree not to:
• Use the website for an unlawful, fraudulent, or harmful purpose
• Attempt to gain unauthorized access to the website or connected systems
• Interfere with website security or operation
• Submit false, misleading, abusive, or malicious information
• Copy or commercially exploit website content without permission
• Impersonate another person or misrepresent your authority to act for a child
We may restrict access or decline service when reasonably necessary to protect our customers, participants, staff, website, or business.
THIRD-PARTY SERVICES AND LINKS
Our website may link to or use third-party services for scheduling, forms, communications, payments, analytics, registration, or other business functions.
We are not responsible for the content, availability, or independent practices of third-party websites and services. Your use of those services may also be governed by their terms and privacy policies.
WEBSITE AVAILABILITY AND INFORMATION
We make reasonable efforts to keep website information current and the website available. However, we do not guarantee that all content will always be complete, error-free, current, or continuously available.
We may correct errors, update information, change services, or temporarily suspend portions of the website when reasonably necessary.
ASSUMPTION OF ORDINARY RISKS
Art activities may involve paint, glue, scissors, tools, small parts, washable or permanent materials, movement, and other ordinary conditions associated with creative activities.
By registering a child or permitting a child to participate, the responsible grown-up acknowledges these ordinary risks and agrees to follow reasonable safety instructions.
Nothing in these Terms is intended to waive rights or responsibilities that cannot legally be waived.
LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Messy Middle Studio will not be liable for indirect, incidental, special, or consequential losses arising from the use of our website, products, or services.
Messy Middle Studio is not responsible for loss or damage caused by inaccurate information provided by the customer; undisclosed medical, allergy, accessibility, or safety concerns; unsafe premises; participant conduct; or failure to follow reasonable instructions.
Nothing in these Terms excludes or limits liability when doing so would be prohibited by law.
INDEMNIFICATION
To the extent permitted by law, you agree to be responsible for claims, damages, or expenses resulting from your unlawful use of the website, your violation of these Terms, intentionally false information you submit, or your infringement of another person’s rights.
PRIVACY
Our collection and use of personal information are governed by our Privacy Policy. Please review that policy before submitting information through the website.
GOVERNING LAW
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Any legal proceeding relating to these Terms or services provided directly by Messy Middle Studio will be brought in an appropriate court serving St. Louis County, Missouri, unless applicable law requires otherwise.
Before filing a legal claim, both parties agree to make a reasonable, good-faith effort to resolve the concern directly.
CHANGES TO THESE TERMS
We may update these Terms as our website, services, or legal obligations change. Updated Terms will be posted on this page with a revised “Last updated” date.
Changes will apply prospectively and will not retroactively alter the material terms of a confirmed, paid booking unless both parties agree.
SEVERABILITY
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
ENTIRE AGREEMENT
These Terms, our Privacy Policy, and the specific service, payment, cancellation, and confirmation information provided for a booking constitute the agreement between the customer and Messy Middle Studio concerning that service.
